Welcome to Apex Texas Street Cop. These Terms of Service ("Terms") govern your access to and use of the Apex Texas Street Cop mobile application (the "App"), the website located at apexstreetcop.com (the "Site"), and any related services, features, local databases, or content provided by Garrett Miller (collectively, the "Service", "we", "us", or "our").
Please read these Terms carefully before downloading, installing, or using the Service. By creating an account, accessing, or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, you are explicitly prohibited from accessing or using the Service.
1. LEGAL DISCLAIMER AND NO LEGAL ADVICE
1.1 Unofficial Reference Tool Only. The Service is provided strictly as an unofficial field reference tool intended to support situational tracking, operational guidelines, and general legal awareness.
1.2 No Legal Counsel. The content, summaries, case law breakdowns, statutory indexes, penal charts, and procedural guides contained within the App do not constitute formal legal advice, nor do they create an attorney-client relationship.
1.3 No Supersession of Departmental Policy. Under no circumstances does the data or guidance within the Service supersede, replace, alter, or override any local, municipal, county, or state law enforcement agency’s Standard Operating Procedures (SOPs), General Orders, direct supervisor mandates, or official departmental guidelines. Users are entirely responsible for executing their official duties in compliance with their respective agency policies.
1.4 Mandatory Duty to Verify. Because law enforcement actions carry severe constitutional and legal consequences, the Service is restricted to use as a secondary lookup tool. You maintain an absolute, independent professional duty to reference official, certified legislative portals (such as the official Texas Constitution and Statutes repository) or official departmental channels to verify statutory entries, weight brackets, or case text before executing arrests, searches, seizures, or report filings. You agree that reliance on this App as a primary authority for legal enforcement action is strictly prohibited.
2. STATUTORY ACCURACY, OFFLINE DATA, AND UPDATE DELAYS
2.1 "As-Is" Local Database. The App is designed primarily as an offline-first mobile engine parsing over 10,000 components of Texas law locally to ensure performance in geographic service dead-zones. While we make every commercially reasonable effort to ensure that local SQLite/JSON databases match official text, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.
2.2 Legislative Update Latency. Laws, penalty brackets, and judicial precedents change frequently. You explicitly acknowledge that local offline data models are subject to update delays. Garrett Miller does not warrant, promise, or guarantee that structural law sections or legal summaries are perfectly error-free, complete, or reflective of emergency statutory amendments enacted after a local sync point. You assume all operational risks related to data lag or typographical discrepancies.
3. ACCOUNTS, ELIGIBILITY, AND OFFICER VERIFICATION
3.1 Public Access. The App is open to the general public for basic features. However, tactical features, advanced tools, and department/agency-specific operational modules are strictly fenced off and reserved for verified accounts.
3.2 Voluntary Officer Verification. Users seeking access to future fenced tiers may undergo an operational verification sequence. During this process, you may voluntarily submit employment information (such as your active law enforcement agency, assignment context, or official email domain). All such data is collected and processed strictly in accordance with our Privacy Policy. We do not request, process, or store digital copies of government-issued identification cards.
3.3 Account Responsibility. You represent that any employment data or organizational details you voluntarily submit are completely truthful, accurate, and current. Submitting fraudulent verification criteria or misrepresenting active law enforcement status will result in immediate, permanent termination of your account and block your access to all related platforms.
4. SUBSCRIPTIONS, BILLING, AND COMMERCIAL TIERS
4.1 App Store Transactions (B2C). Premium tiers purchased by individual users are processed exclusively via third-party application stores (Apple App Store Connect and Google Play Store) with entitlement routing supported via RevenueCat. All financial transactions, renewals, price shifts, subscription updates, cancellations, and refund requests are bound by the explicit terms, billing procedures, and conditions of Apple Inc. or Google LLC respectively. Garrett Miller does not collect or manage your raw payment information.
4.2 Agency Enterprise Addendums (B2B). Department-level bulk packages, custom municipal whitelist integrations, white-label interfaces, or specific local SOP data imports are subject to a distinct, separate contract or purchase agreement ("Agency Addendum"). In the event of an explicit structural conflict between these standard Terms and a signed Agency Addendum, the conditions listed within the signed Agency Addendum shall govern.
5. INTELLECTUAL PROPERTY RIGHTS
5.1 Proprietary Structures. All custom components within the Service—including but not limited to the underlying mobile source code, custom asset scripts, the visual arrangement of the high-contrast modular search grid, specialized 2-line result text truncation algorithms, and compiled internal text summaries of case law—are the exclusive intellectual property of Garrett Miller and are protected under copyright, trademark, and unfair competition laws.
5.2 Reverse Engineering Prohibited. You are strictly prohibited from parsing, extraction, scraping, copying, distribution, or reverse-engineering the structural local SQLite database arrays, custom audio field command streams, or vector asset models bundled inside the compiled software distribution.
5.3 Trademark Rights. The name "Apex Texas Street Cop", the stylized tactical "A" emblem, and all associated color themes represent exclusive trade dress elements owned by Garrett Miller. No license to duplicate or adapt these brand indicators for competing distribution formats is provided under these Terms.
6. LIMITATION OF LIABILITY
6.1 EXPRESS NEGLIGENCE DISCLOSURE. TO THE ABSOLUTE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW WITHIN THE STATE OF TEXAS, GARRETT MILLER SHALL NOT BE HELD LEGALLY LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER.
6.2 SCOPE OF EXCLUSIONS. THIS UNCONDITIONAL LIMITATION APPLIES DIRECTLY TO—BUT IS NOT LIMITED TO—DAMAGES RESULTING FROM CIVIL LIABILITY CLAIMS, TYPOGRAPHICAL RECOVERY DISCREPANCIES, FORMATTING ERRORS WITHIN GENERATED REPORTS, MISSED STATUTORY COMPLIANCE DEADLINES, PERSONAL SAFETY RISKS, LOST DATA, DEVICE FAILURE, EVIDENCE SUPPRESSION ISSUES, OR LOSS OF EMPLOYMENT/DISCIPLINARY ACTIONS ARISING OUT OF OR CONNECTED WITH YOUR RELIANCE ON OR INABILITY TO UTILIZE THE SERVICE, EVEN IF GARRETT MILLER HAS BEEN EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. GOVERNING LAW AND JURISDICTION
7.1 Texas Jurisdiction. These Terms, your interaction with the App, and any legal actions or claims arising directly from your use of the Service shall be governed exclusively by the laws of the State of Texas, without regard to conflict of law metrics.
7.2 Exclusive Venue. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service must be instituted exclusively in the state courts sitting in Guadalupe County, Texas, or the United States District Court for the Western District of Texas (San Antonio Division), and you hereby waive any objection to the venue or personal jurisdiction of such courts.
8. CHANGES TO THESE TERMS
We reserve the right to revise, update, or append sections of these Terms at any time to reflect structural changes in our service roadmap, deployment tools, or state law. Any modifications will become effective immediately upon being posted to apexstreetcop.com. Your continued use of the App following a revision point confirms your binding acceptance of the updated Terms.
